    16th August 2007  Enhanced Hedgerow Management Cutting
             
    Entry Level Stewardship hedges/ditches that are in EB3 and EB10 can be cut from 1 st September, the hedge height should be no less than 2 metres

    ELS Cutting ditches under EB6 and EB7 can proceed from the 15 th September to 28 th February. Ditch cleaning should take place only once during your agreement.
             
    Pollen and Nectar topping date approaches
             
    All pollen and nectar mixes should be topped between the 15 th September and 31st October
             
    CROSS COMPLIANCE REQUIREMENTS SUSPENDED TO HELP FLOOD AFFECTED FARMERS
     
    Derogation of GAEC 3 and Grazing on Set-aside, permission to use of GAEC 12 land and flexibility on GAEC 9.

    Environment Secretary Hilary Benn has extended the suspension until the end of August of the cross compliance standard to enable farmers to use mechanical equipment and vehicles on waterlogged soil and access their crops.

    Mr. Benn continues to listen to the concerns raised by farmers affected by the recent weather affecting many regions in England. These concerns have centered around the difficulties posed by GAEC 3, which the Environment Secretary instructed the department to temporarily suspend the restrictions previously and has issued additional guidance.
    He also authorised the Rural Payments Agency to allow farmers to use set aside land for grazing of animal and harvesting of hay and silage.
    Set-aside – Derogation to allow grazing on set-aside land due to flooding The Rural Payments Agency has already announced that they have made derogation available to allow land set-aside in 2007 to be grazed or harvested for animal feed. This derogation allows farmers to graze set-aside land with their own animals or harvest hay or silage for their own use. Farmers wishing to make use of this derogation should telephone, e-mail or write to the RPA Customer Service Centre providing the reference numbers for the fields which they wish to graze or harvest.

    Additional Information
    Land not in Agricultural Production (GAEC 12 land) can be used for grazing if farms are affected by the wet conditions and this is necessary for animal’s health or welfare. In this case the RPA would not want claimants to notify the change of field codings. Farmers also have the option at any time to put this land into ‘production’ and can then notify RPA at the time of their next SPS claim in the spring.

    The situation is similar in relation to GAEC 9 (overgrazing and unsuitable supplementary feeding on natural and semi-natural grassland), where exceptional conditions exist and this is necessary for animal’s health or welfare, these activities are permissible, but should be recorded on the claimant’s Soil Protection Review.

    During this period it is likely that Statutory Authorities or those acting on their behalf may need access to claimant’s land following the flooding for such activities as watercourse clearance and emergency or remedial works, this situation is covered in the Cross Compliance Handbook 2006 (paragraph 206) which confirms that third parties coming onto farmland under their statutory authority such as for carrying out emergency works will not effect farmers cross compliance. It would be best if farmers notify RPA and record any soil damage on their Soil Protection Review.

     
     
    Setaside dates and GAEC 12
    Cutivation of set aside land to control weeds is allowed from July 1st, all other cultivations can take place after July 15th. Cutting of set aside should take place between July 15th – August 15th. Land in GAEC 12 (Land not in agricultural production) can only be cut after August 1st
             
    Cutting dates for hedges and margins
    • Hedgerows under the Cross compliance rules and EB1 and EB2 can be cut after 31 st July
    • 2m Grass margins(GAEC 14) can be cut after July 31 st
    • Note hedgerows in the enhanced management option EB3 can not be cut until September 1 st
    • Two and four metre grass margins can be cut regularly in the first 12 months then no more than one year in five to control woody growth
    • Six metre margins can be cut regularly in the first 12 months, the 3 metres nearest the crop can be cut annually after mid July, the other 3 metres should not be cut more than one year in five to control woody growth
    • Remember to leave two, four and six metre margins in grassland that are to be cut for hay and silage. The aftermath can be grazed.
             
    RB209 delayed until 2009
    A cash freeze by DEFRA has resulted in the revamped RB209 being delayed until 2009

    Take care topping field margins next to ditches and hedges. Farmers should avoid topping these field margins at this time of year, however it is permissible but always consider ground nesting birds. Establishing a rich grass mixture will help control weeds and spot spraying is permissible in 2 and 1 metre margins. More
             
    15th May 2007 Agricultural Waste Regulations
    Burning and dumping of packaging from fertiliser bags, spray cans, silage wrap, string and net wrap are no longer legal. Particular attention should be paid to cleaning pesticide containers, proper triple rinsing will avoid them being classified as hazardous waste. More
